In its judgment on Tuesday, the appellate court ordered the immediate reinstatement of the officials, all of whom are members of the All Progressives Congress (APC). The ruling comes as a major victory for the affected chairmen and councillors, who were removed shortly after Governor Adeleke assumed office in November 2022.
However, the Osun State Independent Electoral Commission (OSSIEC) has filed an appeal challenging the ruling and also submitted an application for a stay of execution, seeking to halt the reinstatement until the case is fully resolved.
It will be recalled that the local government officials were initially removed following a High Court ruling that nullified their election, which was conducted by OSSIEC under the previous administration. The Peoples Democratic Party (PDP) and other political parties had approached the court, arguing that the election process was flawed. They contended that APC candidates were the only ones who contested the positions, and voters were merely given a “YES” or “NO” option rather than a competitive election.
With OSSIEC’s fresh appeal, the legal battle over the legitimacy of the local government elections in Osun is set to continue.
