Isaac – If Shettima is found guilty of double nomination, he will be jailed & BAT will be disqualified

The parties requested the disqualification of Tinubu’s vice-presidential candidate, Kashim Shettima, claiming that he breached section 115 (D) of the Electoral Act.

They argued that when Shettima accepted the nomination to be Tinubu’s running mate, he was already a senatorial candidate, and therefore, his double nomination violated the electoral act. 

Isaac Anumudu, a legal practitioner, stated in an interview with Channels TV that the court can conclude the double nomination case against Shettima in one day.

To do so, the court needs to obtain the certified true copies of Shettima’s nomination papers from the Independent National Electoral Commission (INEC) and determine whether or not he is guilty of double nomination.

If Shettima is found guilty, he will be disqualified and jailed, according to section 115 subsection (1k) of the electoral act. Tinubu will also be disqualified because their ticket is a joint ticket.

Anumudu explained that section 115 (D) of the electoral act forbids a candidate from filling nomination forms for two elective positions, and section 115 subsection (1K) criminalizes this action, stating that the person will be sentenced to two years imprisonment if found guilty of double nomination.

The opposition parties alleged that Shettima filled two nomination forms for both the senate and vice president, which violates the electoral act. Anumudu emphasized that if Shettima is disqualified, it will affect Tinubu since their ticket is a joint ticket. Therefore, the court must address the matter by law and determine if Shettima’s double nomination was a breach of the electoral act, which could lead to disqualification and imprisonment.
