The constitution does not prohibit the President-elect’s inauguration because a legal issue is ongoing, claims Barrister Monday Ubani, a former vice president of the Nigerian Bar Association.

He made it crystal clear that the Constitution’s timeline had to be adhered to. In addition, he stated that the 180-day deadline might not be met, just as many lawyers had previously argued for. However, he added that the Constitution specifies the days that should be used in the Tribunal and the Supreme Court. 

It’s been suggested that you finish the trail in seven days, he remarked. That doesn’t seem likely to me. For more details, see Section 285 of the Constitution. It specifies when these cases must be decided, first at trial and then by the Supreme Court, which serves as the appellate court. The court is not compelled to take up all 180 days even though you have that much time to finish the process. 

After the 60-day Supreme Court window, you cannot claim that the elected person shouldn’t be sworn in because of the Tribunal. The Legal Framework does not in any way address that. Perhaps we ought to review and change that constitutional provision. Continue Reading….
